Welcome to Vanyam Exports. By accessing this website (vanyamexports.com) or placing an order with us, you agree to be bound by the following terms and conditions.
1. General Provisions
The Entity: “We”, “Us”, and “Our” refer to Vanyam Exports, headquartered in Raipur, Chhattisgarh, India. “Buyer” or “Client” refers to the entity purchasing goods.
Agreement: These terms apply to all sales, contracts, and quotes unless a specific written contract overrides them.
2. Products and Specifications
Agro-Nature: Our products (Spices) are natural agro-commodities. While we strive for consistency, minor variations in color, texture, or size may occur due to harvest conditions. These do not constitute a defect.
Accuracy: We display product images and specifications (e.g., Curcumin content, Moisture levels) as accurately as possible. However, final specifications will be confirmed in the Certificate of Analysis (COA) provided with the shipment.
3. Pricing and Quotations
Volatility: Agro-commodity prices fluctuate daily based on market availability and crop yields.
Quotes: Price quotations provided via email or WhatsApp are valid for 48 to 72 hours (unless specified otherwise). We reserve the right to adjust prices before the final Proforma Invoice is generated.
Currency: All export invoices are raised in USD (United States Dollars) unless agreed otherwise.
4. Orders and Payment Terms
Order Confirmation: An order is considered confirmed only upon the issuance of a Proforma Invoice (PI) signed by authorized Vanyam Exports personnel.
Payment Methods: We generally accept:
T/T (Telegraphic Transfer): Advance payment percentages as agreed in the PI.
L/C (Letter of Credit): Irrevocable, confirmed, and at sight from a prime bank.
Non-Payment: Failure to adhere to payment timelines may result in order cancellation or delayed shipment.
5. Shipping and Delivery
Incoterms: All shipments are governed by Incoterms® 2020 (e.g., FOB, CIF, CFR) as specified in the Proforma Invoice.
Timeline: We strive to ship within the agreed lead time (usually 10-20 days from advance receipt). However, we are not liable for delays caused by shipping lines, port congestion, or customs inspections.
Insurance: For CIF/CIP orders, we provide marine insurance. For FOB orders, insurance is the Buyer’s responsibility once goods cross the ship’s rail.
6. Quality Control and Inspection
Inspections: We encourage Third-Party Inspections (such as SGS, Bureau Veritas) at the time of loading. The cost of such inspections is to be borne by the Buyer unless agreed otherwise.
Claims: Any claims regarding quality or quantity must be made in writing within 7 days of the container’s arrival at the destination port, accompanied by a valid survey report. Claims made after this period will not be entertained.
7. Intellectual Property
All content on this website, including the Vanyam Exports logo, text, images, and graphics, is the property of Vanyam Exports and is protected by copyright laws. Unauthorized use or reproduction is prohibited.
8. Force Majeure
Vanyam Exports shall not be liable for any failure to perform its obligations where such failure is a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane, or other natural disasters), war, invasion, act of foreign enemies, hostilities, government sanctions, or trade embargos.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts in Ambikapur, Chhattisgarh, India.
